Abstract

The rights of Indigenous peoples and the recognition of their rights on and under their traditional territories give rise to crucial legal and policy questions on how Indigenous peoples should directly and indirectly participate and benefit from oil and gas activities. This chapter provides a detailed international law and theoretical assessment of the rights of Indigenous peoples, including rights of self-determination, relevant to oil and gas activities. It provides an examination of substantive and procedural rights and the relative roles of governments and corporations in upholding Indigenous rights throughout petroleum exploitation. Finally, the chapter considers the status and potential of indigenous rights in offshore petroleum development.
